Wittio offers subscription plans that automatically renew until cancelled. To avoid being charged, you must cancel your subscription at least 24 hours before the end of your current trial or subscription period.

PLEASE READ THESE TERMS CAREFULLY. THIS AGREEMENT CONTAINS A BINDING ARBITRATION PROVISION IN SECTION 13 THAT AFFECTS YOUR LEGAL RIGHTS. DISPUTES MUST BE RESOLVED IN ARBITRATION ON AN INDIVIDUAL BASIS — WITHOUT A JUDGE, JURY, OR CLASS ACTION.

THIS AGREEMENT ALSO CONTAINS DISCLAIMERS OF WARRANTIES, LIMITATIONS OF LIABILITY, AND A CLASS ACTION WAIVER.

1. ACCEPTANCE OF TERMS

These Terms of Use & Service (the "Terms" or "Agreement") constitute a legally binding agreement between you ("User", "you") and ASTREVON LIMITED, with registered office at Georgiou A, 83, Shop 17, Germasogeia, 4047, Limassol, Cyprus ("[PRODUCT NAME]", "we", "us", or "our").

These Terms govern your access to and use of the website wittio.io and all associated services, content, and features (collectively, the "Service").

By accessing or using the Service in any way — including browsing the website, registering an account, or purchasing a subscription — you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree, please stop using the Service immediately.

All additional policies referenced herein, including our Privacy Policy, Cookie Policy, and Subscription Policy, form an integral part of this Agreement.

We reserve the right to amend these Terms at any time by posting an updated version on our website. Changes take effect upon posting. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not accept the amended Terms, you must stop using the Service within fourteen (14) days of being notified.

2. DESCRIPTION OF THE SERVICE

Wittio is a digital brain training and self-discovery platform. The Service includes:

Mind Profile & Cognitive Assessment — personalised results based on your quiz responses, including a cognitive profile, strengths analysis, and recommended training plan;
Self-Discovery Tests — including, but not limited to, Archetype, Personality Type, ADHD Screening, Love Style, Career Fit, and Emotional Intelligence assessments;
Brain Training Games — including Sudoku, 2048, puzzles, and other cognitive games. Certain games may be powered by third-party providers integrated into the platform;
Articles — expert-written, science-informed content on topics including memory, focus, stress management, productivity, and cognitive performance;
Courses — structured learning programs designed to improve specific cognitive and personal development skills, such as memory, attention, communication, and emotional regulation.

Important Disclaimer Regarding Tests and Assessments

All tests, assessments, and results provided through Wittio — including but not limited to IQ-related assessments, personality types, ADHD screening, and emotional intelligence evaluations — are intended for educational and entertainment purposes only. They do not constitute professional psychological, medical, psychiatric, or any other form of clinical evaluation or diagnosis. Results should not be used as a substitute for advice from a qualified professional. If you have concerns about your mental health or cognitive functioning, please consult a licensed healthcare provider.

3. ELIGIBILITY AND USER ACCOUNTS

3.1 Eligibility

To use the Service, you must be at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into binding contracts. By using the Service, you confirm you meet these requirements.

Wittio does not knowingly collect personal data from individuals under the age of 18. If we become aware that a user is underage, we will promptly terminate their account and delete associated data.

3.2 Account Registration

To access the full Service, you must register an account by providing a valid email address and any other information required during the registration process. You may also be able to register using social media credentials.

3.3 Account Security

You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised access or suspected breach of your account security.

You may not share, sell, transfer, or provide access to your account to any third party. Each person may hold only one account on the platform.

You agree to keep your contact and billing information accurate and up to date at all times.

4. SUBSCRIPTIONS, PAYMENTS, AND BILLING

4.1 Subscription Plans

Wittio offers the following subscription plans. All prices are displayed in USD for US users and converted into the applicable local currency (GBP, EUR, AUD, CAD, JPY, or other) for users in other supported regions at the prevailing exchange rate at the time of purchase.

Prices shown in local currencies are approximate and may vary slightly due to currency fluctuation. The applicable price will always be displayed on the payment page at the time of purchase. Please review it carefully before completing your purchase.

4.2 Free or Discounted Trials

We may from time to time offer promotional pricing, discounted trial periods, or special offers. Unless otherwise stated, discounted offers will automatically renew at the standard (non-discounted) subscription price upon expiry of the promotional period.

4.3 Automatic Renewal

All subscription plans renew automatically at the end of each billing period at the applicable renewal price, unless cancelled before the renewal date. By purchasing a subscription, you authorise Wittio (or its authorised payment processor) to charge the renewal fee to your payment method on file on each renewal date until you cancel.

4.4 Payment

Payment is charged to the payment method you provide at the time of purchase. You are responsible for ensuring your payment method is valid and has sufficient funds. Your card provider may charge additional fees for currency conversion or international transactions.

You authorise Wittio to share your payment details with our third-party payment processor solely for the purpose of processing your subscription payments.

4.5 Cancellation

Your subscription will continue to renew unless you cancel it before the end of the then-current billing period. To cancel your subscription, you may:

Log in to your account and navigate to My Profile → Manage Membership → Cancel Plan; or
Contact our customer support team at support@wittio.io

Upon cancellation, your access to the Service will continue until the end of your current paid period, after which it will not renew, and no further charges will be made. We do not provide partial refunds for unused time within a billing period, except as described in Section 4.6 below.

We reserve the right to cancel or suspend your subscription at any time if you violate these Terms, fail to pay applicable fees, or for any other reason at our sole discretion.

4.6 Refunds

We aim to ensure every user has a positive experience with Wittio. Our refund policy is as follows:

Standard Refund Eligibility. You may request a refund within 30 days of your initial registration. Refund requests submitted within this period will be reviewed and, if approved, will result in a full or partial refund of the subscription fee paid for the current billing period.

This goodwill refund policy is offered at our discretion and does not affect your statutory rights.

Non-Refundable Items. Any promotional credits or bonus amounts added to your account by Wittio as part of a promotion are non-transferable, non-refundable, and expire after 30 days unless otherwise stated.

We reserve the right to refuse a refund if you have violated any provision of these Terms.

EU / EEA / Switzerland Residents. If you are a consumer in the EEA or Switzerland, you have a statutory right to withdraw from a contract within 14 days of entering into it. However, by expressly requesting immediate access to our Service upon purchase, you acknowledge that the right of withdrawal may be reduced proportionally to the value of the Service already received at the time of your withdrawal request. For purchases of individual digital content items made immediately available to you, the right of withdrawal is waived upon delivery.

To exercise your right of withdrawal, please contact us at support@wittio.io with the subject line "Right of Withdrawal" within 14 days of your purchase.

5. USE OF THE SERVICE

5.1 License

Subject to your compliance with these Terms, Wittio grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal, non-commercial purposes.

5.2 Prohibited Activities

You agree not to:

Use the Service for any unlawful, harmful, or fraudulent purpose;
Copy, modify, distribute, sell, sublicense, reverse engineer, or create derivative works of any part of the Service or its content;
Attempt to gain unauthorised access to any part of the Service, other user accounts, or our systems or infrastructure;
Use automated tools (bots, scrapers, crawlers) to extract data from the Service;
Interfere with or disrupt the integrity or performance of the Service;
Share your account credentials or allow any other person to access the Service through your account;
Use the Service to harass, abuse, or harm any other person;
Remove any proprietary notices, labels, or branding from any content within the Service;
Resell or commercialise any part of the Service without our express written permission.

5.3 Third-Party Games and Services

Certain features of the Service — including some brain training games — may be provided by third-party service providers integrated into the platform. Wittio does not control and is not responsible for the availability, accuracy, or content of such third-party services. Your use of third-party features may be subject to additional terms and conditions set by those providers.

5.4 User Content

If you submit any content to the Service (e.g., feedback, comments, or profile information), you grant Wittio a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, and display such content for the purposes of operating and improving the Service.

You agree that any content you submit will not be considered confidential.

6. INTELLECTUAL PROPERTY

All content, software, graphics, trademarks, logos, and materials on the Service (excluding user-submitted content) are the property of Wittio or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any rights in our intellectual property beyond the limited license described in Section 5.1.

If you believe any content on the Service infringes your intellectual property rights, please contact us at support@wittio.io with details of your claim.

7. PRIVACY

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your personal data as described in the Privacy Policy.

8. ELECTRONIC COMMUNICATIONS

By creating an account, you consent to receiving transactional and promotional communications from Wittio via email, SMS, or push notification. You may opt out of promotional communications at any time by following the unsubscribe instructions in any message or by contacting us directly.

9. DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WITTIO DOES NOT WARRANT THAT:

THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE;
ANY TEST RESULTS, ASSESSMENTS, OR RECOMMENDATIONS ARE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE;
THE SERVICE WILL MEET YOUR INDIVIDUAL NEEDS OR EXPECTATIONS.

TEST RESULTS AND COGNITIVE ASSESSMENTS ARE PROVIDED FOR EDUCATIONAL AND ENTERTAINMENT PURPOSES ONLY AND DO NOT CONSTITUTE A PROFESSIONAL EVALUATION, DIAGNOSIS, OR CLINICAL OPINION OF ANY KIND.

10. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, WITTIO, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL WITTIO'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF: (A) THE TOTAL FEES PAID BY YOU IN THE 12 MONTHS BEFORE THE CLAIM; OR (B) USD 100.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Wittio and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service or your breach of these Terms.

12. SUSPENSION AND TERMINATION

You may terminate your account at any time by contacting us at support@wittio.io. Termination of your account does not entitle you to a refund except as described in Section 4.6.

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including violation of these Terms or non-payment of fees.

Upon termination, your license to use the Service ceases immediately.

13. DISPUTE RESOLUTION AND BINDING ARBITRATION

13.1 Informal Resolution

Before initiating any formal legal proceedings, you agree to contact us at support@wittio.io to attempt to resolve any dispute informally. The parties agree to negotiate in good faith for at least sixty (60) days before either party may initiate arbitration.

13.2 Binding Arbitration

If informal resolution fails, any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration as follows:

US residents: administered by JAMS under its then-current rules;
Non-US residents: administered by the London Court of International Arbitration (LCIA) under its then-current rules.

Arbitration shall be conducted by a single neutral arbitrator. Hearings will be held via telephone or videoconference unless an in-person hearing is required by the arbitrator.

Governing Law:

US residents: Delaware law and applicable federal law;
Non-US residents: the laws of England and Wales.

13.3 Class Action Waiver

ALL DISPUTES MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY. YOU AND WITTIO EACH WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTION PROCEEDINGS. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS WITHOUT THE WRITTEN CONSENT OF ALL PARTIES.

BY AGREEING TO ARBITRATION, YOU WAIVE YOUR RIGHT TO A JURY TRIAL.

13.4 Opt-Out

You may opt out of this Arbitration Agreement by sending written notice to support@wittio.io with the subject line "ARBITRATION OPT-OUT" within 30 days of first accepting these Terms. Opting out does not affect any other provision of these Terms.

13.5 Small Claims and IP

Either party may bring claims in small claims court where eligible. Either party may also seek injunctive or other equitable relief in court for intellectual property infringement.

14. GOVERNING LAW AND VENUE

These Terms are governed by the laws of Cyprus. To the extent any dispute is not subject to arbitration, the parties submit to the exclusive jurisdiction of the courts of England and Wales.

15. CHANGES TO THE SERVICE AND TERMS

We may modify or discontinue any part of the Service at any time without notice. We may also update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

16. MISCELLANEOUS

Entire Agreement: These Terms, together with our Privacy Policy and other referenced policies, constitute the entire agreement between you and Wittio regarding the Service.
Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
No Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce it in the future.
Assignment: We may assign our rights and obligations under these Terms to any affiliate or successor without your consent. You may not assign your rights without our written consent.
Language: In the event of a conflict between the English version of these Terms and any translation, the English version shall prevail.
